No amount of money can compensate for the loss of a loved one but it can help to ease the financial burden that often adds to the tragedy of an accidental death. NewLaw provides help, support and guidance – as well as legal expertise – to the families of fatal accident victims.

If the death of your loved one is as a result of someone else’s negligence then you are entitled to be compensated for your loss subject to satisfying certain criteria. We will assist you to make the application for probate should you so wish.

What can you claim?

Personal injury compensation awarded to a family following the death of a loved one can include an amount for the pain and suffering up to the date of death, repayment of actual losses such as funeral expenses and a bereavement award for the deceased’s spouse or parents. Further, you may be compensated for the loss of financial support if you were dependent upon your loved one.

Who is able to claim?

Surviving spouses and cohabitees in a long term unmarried relationship (such as common law husbands and wives) who have lived together continuously for more than 2 years prior to the date of death, can make a claim. Equally, partners in a civil partnership or any individual that has a financial dependency on the deceased i.e. children, may be able to claim compensation too. This can include grandchildren if they are being cared for on a permanent basis by a grandparent that is killed.  Dependent or elderly parents or persons with a disability in a similar dependent position can also be entitled to compensation.

Representation at Inquests

Newlaw has a team of dedicated lawyers who specialise in inquests. Our team regularly attend inquests representing either the family of the deceased or the driver of the vehicle which has resulted in a fatality.

Although you may be called to give oral testimony at an inquest, in certain circumstances you have the right to decline to answer.  In order to protect your interests and to assist you in case a criminal prosecution is being considered, it is often essential that you are advised fully as to your rights.

Our dedicated team will be able to let you know exactly what will happen at an inquest.  We will often have been able to review the Coroner’s file prior to the inquest so that we can inform you as to the issues involved and the evidence hich will be given.

The press are often present at an inquest as they are invariably held in open court. We are also able to liaise with the press on your behalf.
