A Swindon rail worker has been awarded £7,000 damages for sustaining hearing loss as a result of noise at work.
Mr H was employed by British Rail for more than 30 years as a coach painter in the Swindon works. During this time he was exposed to constant noise from the fabricating and riveting of locomotives and coaches.
The constantly noisy environment gradually affected his hearing in both ears. He retired in 1993 and noticed in the late 1990s that he was having to turn the volume of the TV up higher than anyone else in his house and was asking people to repeat themselves.
His legal case against British Rail was managed by specialist occupational injury lawyer Gavin Evans of Cardiff based NewLaw.
"Since British Rail no longer exists, a claim was brought against BRB (Residuary) Ltd who took over the liabilities of British Rail, to compensate Mr H for his hearing loss. Although liability was not actually admitted the case was not contested and BRB (Residuary) agreed to pay Mr H compensation without having to go to court."
Five similar cases have already been settled by Gavin Evans and NewLaw, with about 35 further such cases ongoing. It is likely that there are hundreds if not thousands of other people who have also been exposed to loud noise at work and have suffered hearing loss who have not made a claim however."
