NewLaw have negotiated a £432,000 settlement for a London biker badly injured when a car he was overtaking pulled out in front of him.
Mr D, in his early 30s, was riding outside a line of traffic in Turn Pike Road in July 2007 when a van emerged from the traffic flow and collided with him. The motorcyclist suffered a fractured spine and other damage, and was taken by ambulance to North Middlesex University hospital where he underwent surgery. He was later transferred to St George's hospital, Tooting.
He had been a skilled joiner, but his injuries have meant he has had to give up his work. His recovery was slow and he suffers chronic pain. The van driver's insurers eventually made an offer of £250,000 in settlement of the claim against them.
The offer was refused by NewLaw and, after further negotiations, a figure of £432,000 was agreed.
Mr D now hopes to find alternative employment and has begun to learn to live with his disabilities.
His legal case was managed by Elisabeth Roth, a personal injury specialist with NewLaw.
"Despite the van driver being convicted of careless driving, his insurer didn't give up trying to reduce our client's damages," says Elisabeth Roth.
"They alleged he was driving too fast and therefore partly to blame until the final negotiations, and so caused our client needless worry. I'm glad he's now able to put all this behind him."
